Website Services
The ADA specifically requires hotel reservations and event ticketing systems to provide enough information for disabled patrons to determine whether facility access meets their individual needs. The Web Content Accessibility Guidelines (WCAG) 2.1 Level AA provide standards for website design which are needed for the blind to access content and are the root of a new wave of litigation across the country.
In today’s world, your business can exist with or without a physical location. The internet brings your goods and services to people who never could have seen them before. Technological advances allow those with special needs to access your business and the Web Content Accessibility Guidelines (WCAG) help your website make it possible. In 2024 the U.S. Department of Justice adopted a rule requiring state and local government websites to meet WCAG 2.1 Level AA (ADA.gov fact sheet on the ADA Title II web accessibility rule), and private businesses have been deluged with lawsuits (Fisher Phillips article: Website Accessibility Lawsuits Are Alive and Well Under the ADA). Accessibility Tax Credit
In order to incentivize businesses to adhere to ADA compliance requirements, the U.S. government decided to help businesses that attain accessibility requirements, including for their websites.
Section 44 of the IRS Code allows a tax credit for small businesses while Section 190 of the IRS Code allows a tax deduction for all businesses.
The difference between a tax credit and a tax deduction is that a tax credit is subtracted from what you owe in taxes (after calculating your taxes), while a tax deduction is subtracted from your total income before calculating your taxes. In other words, a tax deduction is applied to your taxable income.
